For decades, the fear of an immigrant injured worker reporting his/her work injury has been immense. The fear of losing the job. The fear of losing the home. The fear of losing the sense of community.
This fear has only increased with the current trend toward the deportation of immigrants. Those in the know realize that this is a shortsighted approach. According to a report by the Public Policy Institute of California, 34% of working adults ages 25 -54 are foreign-born. Just as interestingly, the Pew Research Center estimated that the undocumented rate for immigrants in the State of California is 17% or 1.8 million individuals. Clearly, we have a sizable workforce doing all manner of jobs here in the state.
That being said, there is no requirement that an individual be documented to file a workers’ compensation claim. As a no-fault system, the only requirement is that the individual be injured in the course of employment.
